I agree with Dr. England that the purpose of patents is to protect intellectual
property.  However, the issue to me when I raised the original question was (and
is) whether or not my University will be sued if I happen to distribute confocal
freeware.
 
As Guy Cox has pointed out, Molecular Dynamics HAS attempted to shut down
distributors of freeware, successfully in at least one case. I'm unsure of
whether you are representing MD's position, but if so, are you saying that MD is
quitting this practice?
